When a co-worker tells you not to throw a birthday party for him, you may want to listen.
Kevin Berling has severe anxiety that can cause panic attacks and requested Gravity Diagnostics not celebrate his birthday. They did anyway, he freaked out, and then they fired him.
Berling sued and on March 31st a jury awarded him $450-thousand because they concluded he suffered an “adverse employment action” because of his anxiety disability.
Court documents show the company did not take the panic attacks seriously and criticized him for his reaction. The company stands by their decision to fire him, accusing him of being potentially violent.
